Electronic Communications Consent

This Electronic Communications Consent is incorporated into and forms part of the Stack Platform Terms of Use.
Healthcare benefits and financial transactions require formal documentation. In many cases, federal and state law require certain information to be provided “in writing,” meaning you are entitled to receive that information in paper form.
Stack Healthcare, Inc. (“Stack,” “we,” “us,” or “our”) operates a digital platform. To access and use certain Services, you must consent to the use of electronic records and electronic signatures.
This Electronic Communications Consent (“Consent”) explains:
The types of information that may be provided electronically;
How electronic records and signatures function on the Platform;
Your rights to request paper copies;
The system requirements necessary to access Documentation electronically; and
How you may withdraw your consent.
You provide your consent to electronic records and signatures during account registration, enrollment, or transaction flow by selecting the acceptance mechanism presented to you or by proceeding after being presented with this Consent.
If you do not provide consent, you will not be able to proceed electronically or access Services that require electronic records and signatures.
Capitalized terms not defined in this Consent have the meanings provided in the Platform Terms of Use.
1. Information That May Be Delivered Electronically
If you consent to electronic delivery during account registration or use of the Services, Stack may provide the following categories of information in electronic form (collectively, “Documentation”):
Account agreements and amendments;
Approvals of purchases, reimbursements, billing, or debits of financial accounts or reserves;
Healthcare-related notices or benefit documentation;
Adoption or use of healthcare payment accounts;
Tax forms and other reporting documentation related to the Services (“Tax Documentation”); and
Other transactional or regulatory documentation associated with the Platform or Services.
Electronic delivery may occur through:
Your email address on file;
Your online account;
The Platform website;
Access through a link delivered by email, text message, or other electronic notice; or
Any other electronic method disclosed at the time Documentation is provided.
Stack may, at its discretion, provide Documentation in paper form even if electronic delivery is available.
Stack does not guarantee that electronic communications will be received. You are responsible for providing and maintaining accurate and current contact information associated with your account.
2. Consent to Electronic Records and Signatures
By providing your consent during account registration, enrollment, or transaction flow:
You agree that Documentation may be provided to you in electronic form.
You agree to use electronic signatures in connection with the Services.
You acknowledge that electronic signatures have the same legal effect as handwritten signatures.
You agree that electronic records satisfy any legal requirement that information be provided to you “in writing;” and
Your electronic acceptance, including selecting an agreement checkbox or completing a transaction after being presented with this Consent, constitutes your legally binding signature.
This Consent remains in effect unless and until you withdraw it in accordance with Section 6 below.
Withdrawal of consent may limit or prevent your ability to access or use certain Services, and may require closure of your account where electronic records and signatures are necessary for operation of the Platform.
3. Paper Copies
You may download, print, or otherwise retain copies of Documentation that you review or sign through the Platform. We encourage you to save copies of important records for your files.
If this is a consumer transaction, additional rights related to paper copies are described in Section 7 below.
4. SMS / Mobile Communications
As part of your consent to electronic communications, if you provide a mobile phone number to Stack:
You agree to be contacted by or on behalf of Stack at the mobile number provided to receive informational, product or service related messages and communications relating to the Services or Platform, including messages related to your account, reimbursements, enrollment status, or benefit activity. You represent that you are the authorized user of the mobile number provided and that you have authority to consent to receive messages at that number.
Message frequency may vary. Standard message and data rates may apply based on your wireless carrier plan.
You may opt out of SMS communications at any time by following the instructions provided in the message (e.g., replying “STOP”). For assistance, reply “HELP” or contact support.
We may confirm your opt out by text message. If you subscribe to multiple types of text messages from us, we may unsubscribe you from the service that most recently sent you a message or respond to your STOP message by texting you a request to identify services you wish to stop. Please note, that by withdrawing your consent, some functions on the Platform may no longer be available to you. Keep in mind that if you stop receiving text messages from us you may not receive important and helpful information and reminders about your Services or the Platform.
Consent to receive SMS communications is not a condition of purchasing any goods or services.
Stack is not responsible for delays in message delivery caused by wireless carriers or third-party service providers.
5. System Requirements
To access and retain Documentation electronically, you will need:
A computer, tablet, or smartphone with a current, supported operating system;
A current version of a widely used internet browser (such as Chrome, Safari, Edge, or Firefox) with cookies and JavaScript enabled;
An active internet connection;
A valid email address on file with Stack and, if you have agreed to receive text messages, a mobile phone capable of receiving SMS messages;
Software that can display and save PDF files, for Documentation provided in PDF format; and
Sufficient storage space to save Documentation, or a printer to print it.
By providing your consent, you confirm that you are able to access, view, and retain Documentation using the device and software you use to access the Platform.
If our system requirements change in a way that creates a material risk that you will not be able to access or retain Documentation electronically, we will notify you of the change and you may withdraw your consent at that time without charge.
6. Withdrawing Your Consent and Updating Your Contact Information
You may withdraw your consent to receive Documentation electronically at any time by emailing support@stackhealthcare.com, by calling 844-MYSTACK (844-697-8225), or by writing to Stack Healthcare, Inc., 8 East Broad Street, Columbus, OH 43215. Your withdrawal will become effective within a reasonable time after we receive your request. Withdrawal does not affect the validity or enforceability of Documentation provided, or electronic signatures made, before it takes effect.
Because the Platform operates electronically, withdrawing your consent may limit or prevent your ability to access or use certain Services and may require closure of your account, as described in Section 2. Stack does not charge a fee to withdraw consent.
Withdrawing your consent to text messages by replying “STOP” (as described in Section 4) applies only to text messages and does not withdraw your consent to electronic records and signatures under this Consent.
You are responsible for keeping your email address, mobile phone number, and mailing address current. You may update your contact information through your account settings on the Platform or by contacting Stack using the methods above. If an electronic communication to you is returned as undeliverable, we may treat that as a request to update your contact information and may provide Documentation in paper form until your contact information is updated.
7. Paper Copies and Additional Rights for Consumer Transactions
If this Consent applies to a consumer transaction, meaning Documentation that relates to Services you use primarily for personal, family, or household purposes, then in addition to the rights described above:
You have the right to receive Documentation in paper form. You may request a paper copy of any Documentation at any time by contacting Stack using the methods in Section 6. Stack does not currently charge a fee for paper copies but reserves the right to charge a reasonable fee where permitted by applicable law, and any such fee will be disclosed before it is charged.
Your consent applies to all Documentation described in Section 1 for the Services you use, and not only to a single transaction, unless we tell you otherwise at the time a particular record is provided.
Your consent is provided electronically in a manner that reasonably demonstrates that you can access information in the electronic form in which the Documentation will be provided.
Nothing in this Consent waives any right you have under applicable law, including the federal Electronic Signatures in Global and National Commerce Act, to receive certain information in paper form.
